How can a party challenge an arbitrator’s decision in international litigation?

The process of obtaining justice through international litigation can be a complicated procedure in California and one that requires legal counsel to accurately navigate. A party involved in international litigation can challenge an arbitrator’s decision if they believe the decision was made in error. To challenge an arbitrator’s decision in California, the party must demonstrate to a court of law that the decision was incorrect and/or illegal in some way. The party must provide solid evidence of the arbitrator’s errors, such as research and documentation that proves the arbitrator’s decision was incorrect or flawed. Additionally, the party must provide legal counsel to argue their case in court. If the court agrees that the arbitrator’s decision was flawed or incorrect, then the court will make the appropriate adjustments to the decision and the case will move forward accordingly. If a party believes the decision of an arbitrator is incorrect, then a challenge to the decision is not only allowed, but expected in a court of law.
