What is the role of the International Court of Justice in international litigation?

The International Court of Justice (ICJ) is a court established by the United Nations Charter to settle legal disputes among countries. The ICJ is the principal judicial organ of the United Nations and its decisions are binding on countries that are parties to the dispute. In international litigation, the ICJ plays the role of a dispute resolution body which provides a forum for countries to present their cases and seek a resolution. The ICJ’s jurisdiction encompasses both contentious and non-contentious cases, and involves a wide range of legal matters such as investment disputes, the use of force, war crimes, and territorial and maritime boundaries. The Court has the authority to issue binding and compulsory decisions called “orders” in cases before it. Furthermore, the ICJ’s decisions are recognized and enforced by the international community through the enforcement powers of the United Nations Security Council. In Alaska, the ICJ’s role in international litigation is limited due to its being the only U.S. state that is not a party to the International Court of Justice Statute, which established the Court’s jurisdiction. However, the ICJ does serve as a source of international law in the state, and parties in Alaskan international litigation may choose to bring their case before the ICJ. In any case, the ICJ plays a critical role in international litigation globally, and the decisions of the Court are binding and enforceable worldwide.
