What is the purpose of a motion for reconsideration in an international court?
A motion for reconsideration is a legal tool used in international courts. Its purpose is to allow parties to challenge the decision of a court by asking the same court to review and change its original ruling. Generally, the motion must be made within a limited period of time after the initial decision is delivered. Its purpose is to give parties to the case a second chance to correct any misunderstandings or errors that may have been made in the previous decision. As the motion is heard by the same court that made the initial decision, the ruling may be changed or modified to address any mistakes that may have occurred. It is a less costly alternative to appealing the decision in a higher court, and may also be used to bring new evidence to the court’s attention. When a motion for reconsideration is accepted, the court will usually order a hearing to consider the new evidence, as well as to review the arguments made by the party requesting review. The court will typically have to weigh the relevancy and credibility of the new evidence, and decide whether it was ignored by the court the first time around. If the court determines that the original decision was wrong, it may order a new ruling on the case.
