Is marriage a type of immigration status?

No, marriage is not necessarily a form of immigration status. While legally marrying a foreign national in West Virginia does provide them certain rights and benefits, it does not directly grant them immigration status. In the United States, the Department of Homeland Security and the United States Citizenship and Immigration Services (USCIS) are responsible for processing and granting applications for green cards, visas, and other forms of immigration status. In order for an individual to gain immigration status through marriage in West Virginia, they must first apply for a marriage green card, which combines a marriage petition and the green card application. If approved, the individual will gain a conditional permanent resident status for two years. After two years they must reapply for the status to be made permanent. In some cases, however, a foreign national may be immediately eligible for permanent residency by marrying a United States citizen. It is important to note that marriage alone does not grant immigration status. It is only the starting point, and the foreign national must still take additional steps to gain a green card or other form of immigration status.
