How do I prove that my spouse and I have a valid, ongoing marriage?
In West Virginia, there are several forms of evidence you can provide to prove that your marriage is legitimate. The most reliable evidence is a valid marriage license issued by the state. If your marriage was not recognized by the state, you can also provide evidence such as jointly filed tax returns, joint bank accounts, shared health and life insurance policies, proof of shared debt or rental agreement, and other evidence of cohabitation. You can also provide supporting documentation such as birth certificates, proof of mutual affection or letters from family or friends that verify the marriage. Additionally, if you’ve been living together in a shared residence, rental agreements or utility bills paid jointly in both your names may also be accepted. If your marriage was conducted outside the United States, you may be asked to provide evidence that the marriage ceremony was legally performed in the country in which it was held. This evidence can include the marriage certificate or an affidavit signed by the officiant or two witnesses who attended the ceremony. Finally, if you’ve undergone any name change as a result of your marriage, you’ll need to provide evidence such as legal documents or other official affidavits to prove the validity of the name change. By providing these various forms of evidence, you can demonstrate to the Immigration authorities that your marriage is valid and ongoing.
