What is a “T visa” and how do I qualify?

A T Visa is a type of legal document that allows victims of human trafficking to remain in the United States for a certain amount of time. The T Visa was created in 2000 by the Trafficking Victims Protection Act and requires victims to meet certain criteria in order to qualify for the visa. In Pennsylvania, the T visa allows victims to live in the United States while applying for permanent residency. The visa holder must have been a victim of human trafficking, trafficking-related activities such as forced or coerced labor, or a severe form of trafficking in persons. The T visa holder must also have helping law enforcement with the investigation or prosecution of trafficking. In order to qualify for a T visa, the victim must demonstrate that they deserve a favorable exercise of discretion by the government. This includes showing evidence that they have suffered extreme hardship involving difficult physical or psychological conditions if they return to their home country and that they would likely continue to face extreme hardship in the future. For victims of human trafficking in a marriage, the T visa is often the only way to remain in the United States. If the T visa is granted, the spouse may become eligible for a Green Card after three years. They can also apply for work authorization, which allows them to apply for any job in the United States. Additionally, the T visa holder can eventually apply for permanent residency and become a U.S. citizen.
