How do I apply for a Waiver of Inadmissibility?
In order to apply for a Waiver of Inadmissibility in Washington State, an individual must follow the steps outlined in the U.S. Immigration and Nationality Act (INA). First, the individual must file an application for a Waiver of Inadmissibility (Form I-601). This form must include detailed information about the applicant’s background, including their criminal history, any prior deportation orders, and details of the marriage. All of the necessary supporting documentation should be included with the form. In addition, the applicant must also provide proof that they are in a valid marriage. This includes evidence such as marriage certificates, photos, and affidavits from both spouses. The applicant must also provide evidence that they have been living in the U.S. legally, and that their spouse is a U.S. citizen or a Lawful Permanent Resident. Once the form and supporting documents have been submitted, the Waiver of Inadmissibility will be reviewed by the United States Citizenship and Immigration Service to ensure that the applicant meets all of the requirements. Depending on the circumstances, the waiver application can usually be processed within 30 days. If approved, the waiver of inadmissibility will allow the individual to continue living in the United States legally.
