What is the process for obtaining a green card through employment?
In Florida, the process for obtaining a green card (formally referred to as a lawful permanent resident) through employment is thorough and complex. As the first step, an employer must file an immigrant petition for the worker, known as an I-140 form. This form documents the worker’s educational and professional experience and includes a labor certification from the U.S. Department of Labor. Once the I-140 form is approved, the worker can apply for an immigrant visa by filing the I-485 form, otherwise known as an application to register permanent residence or adjust status. The worker is then required to submit their passport, birth certificate, marriage certificate (if applicable), and other documentation. In order to be eligible to apply for an immigrant visa, the employee must hold a job that falls within a specific category recognized by the U.S. Department of State. They must also pass a medical exam, background check, and other screenings and tests. Additionally, the employee must demonstrate the ability to financially support themselves and any family members that may accompany them to the United States. Once all the necessary documents are filed and approved, the employee can attend a visa interview at the U.S. Embassy or Consulate in their home country. During the interview, the employee must demonstrate knowledge of current U.S. immigration policies. If the interview is successful, the employee is given an immigrant visa, allowing them to legally live and work in the United States.
