The process for filing an immigration petition for a foreign national in Washington is fairly straightforward. Generally, the petitioner (generally a family member or employer) must complete and file Form I-130, Petition for Alien Relative, or Form I-140, Immigrant Petition for Alien Worker, respectively. The forms must be accompanied by applicable fees and supporting documents that verify the petitioner’s relationship to the foreign national. Depending on the particular immigration petition, the petitioner may also be required to submit evidence of lawful immigration status, such as a valid visa or green card. In addition to the Form I-130 or Form I-140, the petitioner must also submit a Form G-28, Notice of Entry of Appearance as Attorney or Representative, indicating that the petitioner has retained an immigration attorney.
