How can I appeal an immigration decision?

If you disagree with an immigration decision made regarding your residency in California, you have the right to appeal it. An appeal can be made to the Board of Immigration Appeals (BIA) or a Federal Circuit Court. In order to appeal, you must submit a Notice of Appeal to the BIA and to the court. There are specific timeframes and requirements for the filing process. For example, you must submit the Notice of Appeal within 30 days of the immigration officer’s decision. You must also include evidence, such as any relevant documents, to support your case. It is important to note that not all decisions are eligible for appeal. Generally, if an immigration decision was made by an immigration judge, it cannot be appealed to the BIA. The appeals process for cases before an immigration judge is the traditional court system. In addition, you may be able to appeal if you believe that the immigration officer gave an incorrect interpretation of the law or if the evidence presented was insufficient. You must include a clear argument as to why the decision was incorrect and/or why the evidence was not sufficient. If you would like to appeal an immigration decision, it is advisable to consult an immigration attorney or contact the local Board of Immigration Appeals office. An attorney or office representative can provide further guidance on the process and requirements.
