What are the elements of an insurance claim?
An insurance claim is a formal request for compensation from an insurance company. In order for a claim to be successful, it must meet several specific elements laid out by California law. First, the claimant must have a valid insurance policy. The policy must be in force at the time of the incident and the loss must have occurred during the period of coverage. Second, the claimant must have suffered a loss that is covered by the policy. The insurer must have been notified of the incident and should have received proof of the losses. Third, the claimant must demonstrate that the loss was caused by an event that is covered by the policy. The event must have been unforeseeable and the damages must not have been caused by the insured’s own negligence. Fourth, the claimant must show that the losses meet the financial parameters of the policy. Depending on the policy, the insurance company may cover a portion of the total loss or may require that the claimant provide proof of specific damage. Finally, the claimant must show that all deadlines for filing the claim were met and that all necessary paperwork has been completed. If the claimant is able to demonstrate all of these elements, the insurance company is obligated to pay out the claim. If any of these elements are not met, the claim may be rejected and the claimant may be unable to receive compensation.
