What is an insurance coverage dispute?

An insurance coverage dispute is a disagreement between an insurance company and its insured over their rights and duties under an insurance policy. This type of dispute typically arises when an insured files a claim for coverage under their insurance policy and the insurer denies it. Insurance coverage disputes in New Hampshire are usually resolved through negotiation, mediation, or litigation. When an insurance company denies coverage to an insured, the insured may dispute the insurer’s decision. The insured may argue that the insurance policy was misinterpreted or that the insurance company is acting in bad faith. The insurance company can then be sued for breach of contract or insurance bad faith. When an insurance coverage dispute goes to court, the court will review the language in the insurance policy and the facts of the dispute to determine whether the insurance company acted reasonably in denying coverage or not. The court may also look to state and federal laws that govern insurance policies. If the court finds that the insurance company acted unreasonably, the court may award the insured damages, such as reimbursement for medical bills, legal fees, and other losses. In New Hampshire, insurance coverage disputes are resolved through negotiation, mediation, or litigation. Negotiation and mediation are less expensive and quicker than litigation. However, negotiation and mediation can still be time-consuming and expensive, especially if the parties are unable to reach an agreement. Litigation is typically more expensive, and the parties usually must go through the court system in order to resolve the dispute.
