What is the immigration filing process?

The immigration filing process in Washington is complex, and involves multiple steps. First, individuals must determine their eligibility for entry into the United States and for legal permanent residency or citizenship. Depending on the individual’s circumstances, the filing process can involve applying for a visa, adjusting status, or completing a petition for a family member. Next, applicants must fill out and submit an immigration form, such as the U.S. Citizenship and Immigration Services (USCIS) Form I-485, Application to Register Permanent Residence or Adjust Status. This form should be completed as accurately and honestly as possible, as inaccurate or false information could lead to disqualification from immigration benefits. Depending on the case, applicants will also need to submit additional paperwork, such as proof of lawful entry, work or travel history, or medical records. Once the application is submitted, processing times vary; however, it may take several months or longer to receive a ruling. While the application is pending, some individuals may be eligible for work authorization or travel authorization. Finally, after the application has been approved, the individual may need to attend an in-person interview with USCIS to demonstrate that they are eligible for the requested immigration benefit. During the interview, they will be asked questions to verify that they meet the qualifications. Afterwards, a decision will be made on the application. If approved, the individual may receive a green card, work authorization, and eventually be eligible to naturalize to become a U.S. citizen if they meet the required qualifications.
