What is the process for applying for asylum?

Applying for asylum in Washington requires meeting the definition of a “refugee” under Immigration and Nationality Act. To qualify as a refugee, a person must be “unable or unwilling to return to their country of origin due to persecution or a well-founded fear of persecution due to race, religion, nationality, political opinion, or membership in a particular social group.” To request asylum in Washington, an individual must complete the proper forms which can be obtained from USCIS (U.S. Citizenship and Immigration Services) and file the application within one year of arriving in the U.S. The application must be filed in either the Seattle District or Spokane District office. If the applicant is already in removal proceedings and wishes to apply for asylum, the application must be filed with the Immigration Judge. If the application is approved by USCIS, the applicant will receive a notice of approval. The application can also be referred to a higher level of review or denied. If the application is referred or denied, the applicant can request an appeal. In addition to the application, applicants must also provide supporting documentation, including proof of identity and an explanation for why they are seeking protection. Applicants for asylum will be scheduled for an interview with a USCIS officer. During the interview, the applicant will be questioned about their background, the reasons for their fear of persecution, and their reasons for applying for asylum.
