How do I apply for asylum in the U.S.?

In order to apply for asylum in the United States, you must fill out an application with the United States Citizenship and Immigration Services (USCIS). The form to fill out is called the Application for Asylum and for Withholding of Removal, Form I-589. This application must be sent with evidence of identity and other supporting documents. If you are in Virginia, filing the application can be done in person or by mail. Individuals who are applying for asylum must demonstrate that they have a genuine fear of persecution in their home country due to their race, religion, nationality, political opinion, or membership in a particular social group. All applications must include evidence in order to support the individual’s claim. This can come in the form of personal statements, eyewitness accounts, photographs, and court documents. As well, applicants must also appear for an asylum interview. This generally occurs six to seven months after filing the application. During the interview, an asylum officer will ask the individual questions about their application, personal background, and details regarding their fear of persecution. Upon completion of the initial application and the asylum interview, an asylum officer will make a preliminary decision about the individual’s application for asylum. The individual must then attend a hearing before an immigration judge. This hearing is necessary in order to make a final decision on the individual’s application.
