What is a family-based petition?
A family-based petition is a legal document filed in California by a family member that allows an individual to immigrate to the United States. This type of petition is also known as Form I-130 and is filed by a U.S. citizen or lawful permanent resident with the United States Citizenship and Immigration Services (USCIS). When the family-based petition is approved, the foreign family member can apply for an immigrant visa to come to the United States. The family-based petition is usually the first step for an individual to obtain lawful permanent residence status in the U.S. If their application is approved, the immigrant can receive a green card to remain legally in the United States. The family-based petition process can take anywhere from a few months to several years to process. Additionally, the U.S. citizen or resident must demonstrate a financial ability to support their family member if they are immigrating. In many cases, the sponsor must sign an affidavit of support. If the family-based petition is approved, the sponsored family member may enter the United States and apply for a green card to remain in the United States lawfully. The family-based petition process can be complex, and it is important to consult with a qualified immigration attorney to ensure the process goes smoothly.
