What is a family-based petition?
A family-based petition is a legal petition made by one family member to allow another family member to enter or remain within the state of Kansas. This petition is often used to provide immediate family members, such as spouses, children, siblings, and parents, with a pathway to lawful immigration. Family-based immigration petitions are submitted to the United States Citizenship and Immigration Services (USCIS), who then reviews the case, makes a decision, and issues a ruling. To be approved, the petitioner must prove that they meet the necessary qualifications and that the family relationship is valid and legally recognized. Additionally, both the petitioner and beneficiary must pass a medical examination and security check. Once approved, the beneficiary is then eligible to apply for permanent residence in the US. The family-based petition process is overseen by the Immigration Law system in Kansas, and provides an important opportunity for family members to reunite while also providing the beneficiary with a legal means to remain in the country.
