What is labor certification?

Labor certification is a process that the government of Indiana requires employers to go through for certain immigrants who are applying for legal permanent resident status. Labor certification is a way for employers to prove that no qualified United States workers are available to fill the job. The process begins with the employer filing a petition with the United States Citizenship and Immigration Services (USCIS) for a foreign national to permanently work in the state. The employer must also demonstrate that the position is not temporary or seasonal, and that there is no qualified United States worker available to do the job. Employers must also show that they are paying the foreign worker the same wages and benefits as they would pay a United States worker doing the same job. In some cases, an employer may be required to conduct recruitment to show that there are no qualified United States workers available. After all of these steps have been taken and approved by the USCIS, the foreign worker can then apply for their work visa using the labor certification. This process provides an opportunity for employers to hire foreign workers in certain positions when qualified United States workers are not available.
