What are the requirements for employment-based visas?
To obtain an employment-based visa in Indiana, several requirements must be met. The employer must first obtain a labor certification approval from the US Department of Labor. This must be done before the visa application can be filed. The labor certification will certify that there are no US workers who can fulfill the job and that the job offered does not adversely affect the wages and working conditions of US workers in similar positions. The employer must ensure that the employee’s credentials are in accordance with the job requirements. For example, if the job requires a certain degree or experience, the employee must have the same credentials. The employer must also provide the employee with the employment terms and conditions, and the Immigration and Naturalization Service (INS) must approve it.
