What is the process of applying for a U Visa?

In Mississippi, the United States Citizenship and Immigration Services (USCIS) is the agency that handles the process of applying for a U Visa. The process begins with filing an “Application for U Nonimmigrant Status” or form I-918. The application must be filed with the necessary supporting documents, such as proof of being a victim of certain qualifying criminal activities. It is also necessary to provide evidence that the applicant was helpful in the investigation or prosecution of the crime they were a victim of. The applicant must also file the “Supplement B: U Nonimmigrant Status Certification” form and submit it to a certifying agency which is usually the law enforcement agency which was involved in the investigation or prosecution of the crime. The certifying agency will review the application and if approved, will make a recommendation to USCIS to approve the application. Once USCIS has reviewed and approved the application, the applicant will receive a Notice of Action indicating the approval. The applicant must then move forward with the process of applying for a U visa which includes submission of the required documents and payment of the required fee. After all the paperwork is submitted and the fee is paid, the applicant will be issued a U Visa which will enable them to stay legally in the United States for four years and also apply for a work permit.
