What are the requirements for filing an application for adjustment of status?

Adjustment of status is a process for immigrants living in the United States to obtain lawful permanent resident status, or “green card”, without having to return to their home countries. In order to apply for adjustment of status, immigrants must meet certain requirements under Mississippi immigration law. First, the immigrant must have been inspected and admitted or paroled into the US. For example, if the immigrant entered the US without inspection or holds a valid nonimmigrant visa, they are ineligible to apply for adjustment of status. Second, the immigrant must have an approved immigrant petition, such as an I-130 or an I-140. The petition is filed by a sponsor, such as an immediate relative or employer and must be successful for the immigrant to qualify for an adjustment of status. Third, an immigrant must not have entered the US by fraud or misused a visa. If the individual has done either of these, or has overstayed the length of their visa, they are not eligible to apply for adjustment of status. Lastly, the immigrant must be eligible for the visa classification requested. This means that the immigrant must meet all the qualifications to receive the visa type being requested. If the immigrant meets all these requirements, they can file an application for adjustment of status.
