What is the process for filing an application for an O-1 visa?
The O-1 visa is a work visa granted to individuals who possess extraordinary ability in the sciences, arts, education, business, or athletics. In order to apply for an O-1 visa, applicants must first submit Form I-129, Petition for a Nonimmigrant Worker, to the USCIS (U.S. Citizenship and Immigration Services). This form must include evidence of the applicant’s extraordinary ability and, if applicable, any relevant supportive documents. Additionally, the applicant must provide evidence of a job offer from a North Carolina employer. This evidence may include a contract detailing the wages, benefits, and duration of the job offer. Once Form I-129 has been approved by the USCIS, the applicant must submit a completed Form DS-160, Nonimmigrant Visa Application, with a current passport photograph to the U.S. Department of State. An applicant who is already in the U.S. must be in valid status and may have to submit an additional form, Form I-539, Application to Extend/Change Nonimmigrant Status. The next step in the application process is for the applicant to appear for a visa interview at the U.S. Embassy or consulate with jurisdiction over the applicant’s place of residence. At the interview, the applicant must provide the consular officer with all necessary documents including the approved Form I-129 and Form DS-160. After the interview, the consular officer will decide the fate of the visa application. If approved, the applicant will receive a visa stamp in his/her passport. The applicant must enter the U.S. within the validity period of the visa. Upon entry, an official of the Department of Homeland Security will inspect the applicant’s documents and determine the duration of stay in the U.S. This is typically the same duration as the job offer but may not exceed three years.
