How do I apply for an extension of stay?
In Massachusetts, immigrant individuals can apply for an extension of stay by submitting Form I-539 to the United States Citizenship and Immigration Services (USCIS). This form is required for most non-immigrant visa holders who want to extend their stay beyond the period authorized for them at the time of admission to the United States. The Form I-539 must be submitted to the USCIS regional service center with jurisdiction over the area where the individual is located in the United States. Accompanying the form should be a photocopy of the applicant’s unexpired passport, their current visa, and any supporting documentation. The applicant must also include the application fee and any biometrics fees, if applicable. If the application is approved, the individual will receive Form I-797, Notice of Action, confirming the extension of their stay. This form will have a new expiration date, which will replace the prior expiration date. At the same time, the individual may also have to report to their local United States Citizenship and Immigration Services field office. The purpose of visiting the field office is to update the applicant’s biographical information and receive an extension of stay stamp in their passport.
