What is the process for filing an application for a K visa?
In Michigan, the process for filing an application for a K visa is fairly straightforward. The first step is to complete Form I-129F, Petition for Alien Fiance(e). This form must be completed and submitted to the Department of Homeland Security. The petitioner must include documentation to support the relationship between them and the beneficiary, such as certified copies of birth certificates, a marriage certificate, or other evidence of a relationship. The petitioner must include a copy of the beneficiary’s passport and birth certificate, photos of the couple together, and any other documents to prove their relationship. After the form is submitted, the petitioner will receive a receipt of their application. Once the U.S. Citizenship and Immigration Services (USCIS) receives the application, they will review it and make sure all of the documentation is received and complete. They will then grant or deny the K visa. If the application is approved, the beneficiary and the petitioner must then attend an interview at the USCIS office. During the interview, they will have to provide additional proof of the relationship, as well as answer any questions about the application. After the interview, the beneficiary may either be approved or denied a K visa. If the visa is granted, the beneficiary will have to leave the United States and apply for a K visa at a U.S. consulate or embassy abroad, which typically takes about three months to process. Upon approval, the beneficiary can then use the visa to enter the United States as a fiancé(e) and marry the petitioner.
