What is the Norris-LaGuardia Act?

The Norris-LaGuardia Act is a federal law that was passed in 1932 and restricts the power of courts to issue injunctions in labor disputes. The main purpose of the act is to protect workers’ rights to organize and bargain collectively, while also preventing companies from using injunctions to prevent unions from functioning. The Norris-LaGuardia Act is unique because it basically prevents courts from intervening in labor disputes. This means that if there is an issue between an employer and a union, such as a dispute over wages or hours of work, the Norris-LaGuardia Act prohibits the court from issuing an injunction to stop the dispute. Instead, the law requires the parties to come to an agreement through private negotiation or mediation. The Norris-LaGuardia Act also makes it illegal for companies to require employees to sign “yellow-dog” contracts, which are agreements not to join a labor union. In North Dakota, it is illegal for employers to engage in activities that might interfere with employees’ right to organize. North Dakota’s law also establishes minimum requirements for employer/union negotiations. In short, the Norris-LaGuardia Act is a law that was implemented to protect workers’ right to organize in the workplace and to ensure fair labor practices in North Dakota. It is an important part of Industrial Relations Law in the state and is designed to help maintain a positive and productive relationship between employers and unions.
