What are the requirements for collective bargaining agreements?
In South Dakota, collective bargaining agreements must follow the laws set out by the state. The most important requirement is that employers must recognize the rights of employees to negotiate a contract with a labor organization. This contract must include terms and conditions relating to working hours, wages, safety, training, holidays, and other aspects of the employment relationship. The agreement must also include language that protects the union’s right to strike in the event that negotiations cannot be reached between the parties. Additionally, it must provide language about grievance procedures for addressing issues that are not resolved during the negotiation process. The collective bargaining agreement must also be filed with the appropriate state agencies and must be approved by a majority of the employees entitled to vote on the agreement. The agreement must also be approved by the employer. Additionally, collective bargaining agreements must be renewed every two or three years.
