What are the basic requirements of a collective bargaining agreement?
A collective bargaining agreement (CBA) is an agreement between an employer and employee union that outlines the duties and responsibilities of both parties, as well as how the employer and employee will resolve labor disputes. In South Carolina, the basic requirements of a CBA include the following: 1. A requirement that the employer recognize the union as the exclusive bargaining representative for employees in the bargaining unit. 2. A provision or provisions setting forth the scope of the collective bargaining agreement. 3. A provision or provisions setting forth the terms and conditions of employment, such as wages, hours, and fringe benefits. 4. A provision or provisions requiring the employer to make certain payments, such as dues and other fees, to the employee union. 5. A provision or provisions requiring the employer to provide certain information and/or records, including but not limited to, employee lists, payroll records, financial statements, and employee performance evaluations. 6. A provision or provisions requiring the employer to abide by the terms of the collective bargaining agreement, including a requirement to negotiate in good faith. 7. A procedure or procedures for resolving disputes, including but not limited to, mediation and/or arbitration. 8. A provision or provisions requiring the employer to notify the union of any changes to terms and conditions of employment. Collective bargaining agreements in South Carolina must adhere to these basic requirements in order to be legally enforceable. The agreement should also be in writing and signed by both parties.
