What is the difference between succession and inheritance?
Succession and inheritance are similar terms in Hawaii’s inheritance law, but they do have some key differences. Generally speaking, inheritance is the transfer of wealth or title from a deceased person to a living relative. Succession, on the other hand, refers to the order in which an estate is distributed among heirs. Inheritance law in Hawaii dictates that upon a person’s death, the inheritance must be distributed according to the terms of the deceased person’s will, if there is one. If the deceased had not made a will, the estate is distributed according to the state’s inheritance laws. Inheritance laws in Hawaii are based on the principle of intestacy, meaning that the estate is divided among the deceased’s closest living relatives. Succession law in Hawaii is different in that it specifies the order in which the estate must be distributed among the deceased’s heirs. Generally speaking the estate should be distributed first among the deceased’s spouse and children, followed by any other surviving descendants. The remainder of the estate is than distributed among the deceased’s other relatives in order of closeness, beginning with parents, siblings, and so on. In summary, inheritance law in Hawaii dictates how a deceased person’s estate is ultimately distributed, while succession law specifies the order in which those assets or titles must be passed on to the deceased’s heirs.
