What is a durable power of attorney?
A durable power of attorney (DPOA) is a legal document that allows an individual to assign a representative to manage their finances, medical and legal decisions, or other matters in the event they are unable to do so themselves. This document is most commonly used when an individual is ill or injured, or is otherwise unable to manage their affairs. In Washington, a power of attorney is considered durable if it contains language that indicates it will remain in effect, even if the principal becomes incapacitated or unable to communicate their wishes. The power of attorney document should also name the person (known as the principal) who is giving the authority, and the person (known as the agent) who will be receiving the authority. The agent is legally bound to act within the scope of the durable power of attorney as specified in the document. The power of attorney document may include instructions about how the agent can handle the principal’s finances, medical issues, or other matters. In Washington, the power of attorney must be signed by the principal in front of a notary public in order for it to be valid. After the document is signed, it is important to make sure that the agent understands their role, so that the principal’s wishes will be followed properly.
