What are the trust funding requirements?
Trust funding requirements vary depending on the type of trust to be funded and the assets being transferred. In Florida, trust funding requires the transfer of assets from a settlor (the creator of the trust) to a trustee (the person or entity responsible for managing the trust). The settlor must transfer the asset with the intent that it be held in trust and must ensure that the asset is unencumbered and validly owned by the settlor. In order to fund the trust, a variety of documents must be signed and/or witnessed, including the trust agreement, funding instructions, and any other documents necessary to complete the transfer. In Florida, it is important to note that there are certain assets that cannot be held in trust, such as stocks, bonds, and real estate. Additionally, some assets may require additional authorization, such as a power of attorney or a court order. It is important to note that if the settlor wishes to place restrictions on the trust assets or beneficiaries, such as a procedure for making distributions or the appointment of a guardian for minor beneficiaries, those procedures must be included in the trust agreement. Finally, the trust must be funded with assets that are sufficient to meet its objectives.
