What is a trust document?
A trust document is a legal document that outlines the terms of a trust. A trust is a legal relationship created when one person (the settlor or trustor) transfers assets to another person (the trustee) to be managed for the benefit of a third person (the beneficiary). Trusts are used to protect and manage assets for the benefit of the beneficiary. A trust document contains the settlor’s instructions to the trustee on how the trust will be handled and managed. It outlines the terms of the trust, such as who the trustee(s) is/are, who the beneficiary(ies) is/are, what assets are in the trust, and when the trust will terminate. It also outlines the trustee’s duties, such as investing and managing the trust assets, keeping accurate records and filing tax returns, and providing reports to the beneficiaries. In California, there are many different types of trusts that can be created, including charitable trusts, irrevocable life insurance trusts, family trusts, special needs trusts, trust amendments and revocations, and trust accountings. Each type of trust has its own set of laws and requirements. It is important to seek the advice of an experienced estate planning attorney to ensure that a trust document is in compliance with all applicable state and federal laws.
