What is the Law of the Sea?

The Law of the Sea is an international legal framework that stipulates how countries and other entities have the right to use and interact with the ocean. It is a set of rules and regulations that govern and protect the resources found in the ocean, including fish, oil, gas, and minerals. It also covers topics such as maritime borders, navigation, pollution, and environmental protection. In South Dakota, the Law of the Sea is addressed primarily through U.S. federal and state laws. The U.S. Congress has enacted several laws that provide the basis for the enforcement of the Law of the Sea. The Magnuson-Stevens Fishery Conservation and Management Act of 1976 was enacted to ensure the long-term sustainability of American fisheries, and the Marine Mammal Protection Act of 1972 was enacted to protect Marine mammals from unregulated hunting and the hazards of environmental pollution. Additionally, South Dakota has adopted several legal principles derived from the Law of the Sea, such as the right of innocent passage, the right of unimpeded navigation, the delimitation of maritime boundaries, and the right to access the resources of the deep seabed. The Law of the Sea is a crucial component of international law and helps to shape the way that the world interacts with the marine environment. It provides a framework for nations to cooperate in the use of marine resources and helps protect the ocean from exploitation and pollution.
