What is the Vienna Convention on the Law of Treaties?

The Vienna Convention on the Law of Treaties is an international treaty that was adopted in 1969 and came into force in 1980. It is a cornerstone of international law, and is considered one of the most significant conventions concerning international law and international relations. The Convention provides the rules of international law that conduct the relations between States in regards to treaties. It explains the principles of interpretation and application of treaties, as well as the legal consequences of their conclusion, modification, suspension, termination, and invalidity. The Convention also defines the conditions of the conclusion of treaties, as well as the ways to deposit and register them. In addition, it defines the rules applicable to a treaty as a legal instrument between the States and is the source for the legal construction and interpretation of all international treaties. It also sets out the conditions under which a treaty can be concluded on behalf of a State, and establishes which content is subject to international law. Finally, the Convention is an important source of law for the prevention of conflicts between different legal orders, including those of the countries in South Dakota. Consequently, it provides legal certainty with regard to the enforcement of treaty rights and obligations across international borders.
