What is the International Law of State Succession?

International Law of State Succession is an international legal concept that outlines the process of how a state is formed or reconfigured after a change in government or when a country ceases to exist. Under the International Law of State Succession, when a country undergoes a change in government or ceases to exist, the rights, duties, and obligations of the predecessor state are transferred to the new or succeeding state. The main purpose of the State Succession law is to maintain international peace, stability, and continuity while taking into consideration the wishes of the people of the affected State. The Republic of Georgia is a party to the Vienna Convention on Succession of States in respect of Treaties, which is a major treaty on State Succession. This treaty provides a comprehensive legal framework for State succession in regards to existing and future international treaties. When a change in government or state dissolution occurs, the Vienna Convention on Succession of States in respect of Treaties applies to the Republic of Georgia. The Convention maintains the legal effects of international treaties for newly forming states as well as for successor states, thereby protecting the rights of international actors, such as investors and creditors. The International Law of State Succession is a fundamental part of international law and is applied in the Republic of Georgia to maintain the continuity of the country’s obligations and rights under international treaties, while also considering the wishes of the people involved.
