What is the Rome Statute of the International Criminal Court (ICC)?

The Rome Statute of the International Criminal Court (ICC) is an international agreement that defines the powers and responsibilities of the ICC. This agreement was adopted by a diplomatic conference in Rome in 1998 and came into force in 2002. The ICC is the first international tribunal with the authority to prosecute individuals for genocide and other war crimes. Under the Rome Statute, the ICC is a permanent court that can take criminal action against individuals responsible for the most serious crimes when national courts are unable or unwilling to do so. The ICC is responsible for investigating and prosecuting war crimes, crimes against humanity, genocide, and other serious crimes. The ICC has jurisdiction over individuals, not over states, and can only investigate cases when the countries involved are unable or unwilling to do so. The ICC is meant to complement existing national justice systems, not replace them. In North Dakota, the ICC is not directly applicable to its citizens or government. However, North Dakota is signatory to the Rome Statute and has committed to abide by the ICC’s rules and regulations in the event one of its citizens is accused of a crime that falls within the jurisdiction of the ICC. North Dakota is also obligated to cooperate with the ICC in any investigation conducted in another country.
