What is an investment law?
An investment law is a branch of the law which concerns investments. It is the regulation of the buying and selling of financial assets, such as stocks, bonds, and other forms of property. Investment law also covers the area of capital markets and the regulation of securities in those markets. In North Carolina, the legislation that provides policies on investments is known as the North Carolina Securities Act of 2002. This act outlines the requirements necessary for a company wishing to conduct business in the state and to access capital via the sale of securities. This legislation also provides rules for the setting of trading hours, market supervision, and the penalties imposed upon violators. The Securities Division of the North Carolina Secretary of State Office and the North Carolina Investment Law Enforcement Division, both part of the North Carolina Department of the Secretary of State, are responsible for enforcing the North Carolina Securities Act as well as additional rules and regulations associated with investments in the state. Investment law in North Carolina ensures that people are protected when purchasing investments by providing regulations to guide sellers and buyers and to give investors the information they need to make informed decisions. The intent of the North Carolina Securities Act is to ensure fair practices and to provide a safe environment for investors by monitoring and controlling the investment industry in North Carolina.
