What is the process of setting up an investment law?

Setting up an investment law in Florida can be a complicated process. First, a business must be formed. This requires filing articles of incorporation with the Secretary of State. Then, one or more individuals must be designated as “agents” to represent the business. These agents are responsible for filing required paperwork with the Financial Industry Regulatory Authority (FINRA) to become registered. Once that is complete, the next step is to open a broker-dealer account with a FINRA member firm. This can include filing a Form BD, which provides information about the firm and its agents. The business must also create a business plan, and submit it to FINRA for review. The next step is to acquire a securities license, which requires passing an exam. Depending on the type of license, the exam may be administered by FINRA or the state Department of Financial Services. Once the license is obtained, the business must register with the state regulating authority and apply for a state registration number. Finally, the business must create procedures and policies that adhere to many state and federal regulations. This includes record-keeping, capital requirements, and reporting. After all of this is complete, the business may start offering investment services and products to customers in Florida.
