What is trademark law?

Trademark law is a type of intellectual property law that governs the use of symbols, words, phrases, logos, and designs that distinguish a product or service from those of others. In Washington, trademark law is enforced by the United States Patent and Trademark Office (USPTO). The purpose of the USPTO is to protect the trademark rights of business owners, make sure they aren’t being stolen or infringed upon, and make sure consumers can easily tell the difference between one business’s product or service and another’s. When a company registers a trademark, they are making sure that it is unique and that it serves to identify their goods or services. When a trademark is registered, it means that no other business can use that same mark or a similar one to identify their goods or services. This prevents the public from getting confused or deceived. Trademark law also includes anti-dilution laws which protect a trademark from being used in a way that might lessen its value or reputation. Trademark law also protects businesses from “passing off” when one business tries to make consumers think that their goods or services are associated with another business’s goods or services. Trademark law plays an important role in Washington in protecting the rights of businesses and the public. By ensuring that trademarks are unique and can be easily identified, consumers can be sure that the goods and services they are buying are the ones they are expecting.
