What is an unfair competition case?

Unfair competition is a legal term that refers to behavior that is considered to be deceptive or anti-competitive and directly harms the competitive landscape of a given market. In Mississippi, an unfair competition case is a type of civil lawsuit where one business alleges another has engaged in deceptive or anti-competitive behavior that harms the plaintiff’s business. It includes behavior such as false advertising, misappropriation of a trade secret, trademark infringement, passing off, and other deceptive conduct. When reviewing an unfair competition case, the court will assess the impact of the defendant’s behavior on the plaintiff’s business. Generally, if the plaintiff is able to demonstrate it was damaged in some way as a result of the defendant’s behavior, then the court is likely to find the defendant to be in violation of unfair competition laws. The court will then typically issue an injunction prohibiting the defendant from engaging in the disputed conduct, as well as awarding the plaintiff monetary damages. In addition, Mississippi law also recognizes that whether a defendant’s conduct is considered to be an unfair competition can also depend on a variety of other factors. These can include things such as the history of the plaintiff’s business, the intent of the defendant, the nature of the trade, and public policy considerations. Therefore, if you believe that you have been the victim of unfair competition, it is important to consult with a qualified attorney who can review the facts of your case and advise you of your legal rights and remedies.
