What is an unfair competition case?

An unfair competition case is a legal dispute between two or more parties that involves an alleged violation of the law regarding unfair trade practices or unfair competition. This type of case is particularly relevant to businesses operating in Virginia because the state has a set of laws specifically designed to protect businesses from unfair competition. Unfair competition cases involve a variety of issues, such as false advertising, passing off goods as being associated with one company when it is actually another, and using trade secrets without authorization or permission. When a company or individual believes they have suffered damages due to unfair competition they may file a lawsuit seeking compensation and/or an injunction to stop the offending party from continuing the activity. In Virginia, the actions that are classified as unfair competition are outlined in Section 59.1-9.1 of the Virginia Code. This section includes a detailed list of activities that are prohibited, such as false advertising, disparaging the goods or services of another company, and using another company’s trademarks or service marks without their permission. Any of these activities can be considered a violation of intellectual property law and can be grounds for an unfair competition case.
