What is patent infringement?

Patent infringement is the unauthorized use of patented technology or ideas without permission from the original patent holder. It happens when someone makes, uses, sells, offers to sell, or imports a product that is covered by someone else’s patent in the state of Mississippi. The legal term for patent infringement is “patent infringement claim”, and it is a violation of the patent holder’s exclusive right to their invention or product. Patent infringement can be divided into direct and indirect infringement. Direct infringement occurs when a person knowingly and intentionally uses an invention or product that ispatented. For example, if someone were to produce, sell, or offer to sell a patented invention without the permission of the patent holder, this would be considered an act of direct patent infringement. Indirect patent infringement occurs when a person induces another person to use a patented product or invention. For example, a manufacturer could be held liable for patent infringement if it knowingly induced or caused another person to use a patented product or invention. If a person in Mississippi is found to be infringing on another person’s patent, they could be held liable for patent infringement and be subject to damages including the payment of the patent holder’s fees, court costs, and attorney fees. The best way to avoid patent infringement is to investigate whether a product or invention has been patented before producing, selling, or offering to sell it.
