What is the Patent Cooperation Treaty (PCT)?

The Patent Cooperation Treaty (PCT) is an international treaty that provides a unified procedure for filing patent applications in any of its member countries. This treaty allows an inventor to file a single patent application with a single language that can be used to protect the invention in each member country. The PCT is administered by the World Intellectual Property Organization (WIPO) and currently has 148 member countries, including the United States and most of the countries in the European Union. The purpose of the PCT is to provide a more streamlined and cost-effective way to protect inventions in numerous countries. When filing a patent application in the United States, inventors must file a national patent application with the United States Patent and Trademark Office. However, inventors who file a patent application under the PCT can request international protection for their invention. The PCT also extends the amount of time an inventor has to decide which countries to file a patent application in, allowing the inventor more time to decide which countries to pursue patent protection in. It is important to note that the PCT does not grant any actual patent rights. In other words, an invention is not protected by the PCT until a patent is granted in each individual country. Furthermore, the PCT does not replace the need for inventors to file national patent applications in the countries where patent protection is desired.
