What is intestate succession law?

In Michigan, intestate succession law is the law that determines who will inherit a person’s property if the person dies without a valid will. This is also known as the “laws of intestate succession” or the “laws of inheritance.” The heirs who receive the property under intestate succession law depend on a person’s unique family situation. Generally, the people in line to inherit the property are the person’s spouse, children, parents, or siblings. If the person has none of these, it may go to more distant relatives such as uncles, aunts, and cousins. When a person dies intestate in Michigan, there is a specific order for who will receive the property. For example, if the person is survived by a spouse and children, the surviving spouse will receive the first $150,000 of the estate plus a portion of the remaining balance. The remaining balance will be divided among the children. If there is no surviving spouse or children, the property will pass to the parents of the deceased. If the deceased has no parents, the property will pass to the siblings, and so on. The court will determine exactly how the property is divided among the heirs. Intestate succession law is an important part of estate planning in Michigan. Knowing the laws of intestate succession can help family members understand how the property will be divided in the event that their loved one dies without a will.
