What is the difference between intestate and non-probate assets?
In Washington, there are two types of assets that are distributed upon death, intestate assets and non-probate assets. Intestate assets are those assets that are distributed in accordance with the state’s intestate succession laws. These assets are distributed to the decedent’s legal heirs, as determined by the laws of the state. These assets can include real estate, bank accounts, and other personal property. Non-probate assets, on the other hand, are assets that are distributed outside of the courts. These assets may include life insurance policies, retirement accounts, or other assets where the beneficiary designation has been made. In the case of these assets, the named beneficiary is the individual who is entitled to receive the assets upon the death of the owner. These assets do not have to go through the probate process, and the beneficiary is not determined by the intestate succession laws. In conclusion, the difference between intestate and non-probate assets is that intestate assets are those assets that are distributed in accordance with the state’s intestate succession laws, while non-probate assets are those assets that are distributed outside of the courts, to an individual designated by the asset owner.
