Who can serve as the administrator of an intestate estate?

In the state of Florida, when an individual dies without leaving a will, the process is known as “intestate succession.” In such cases, the court appoints an administrator to manage the deceased person’s estate. The administrator is responsible for collecting and accounting for assets, filing tax returns and probating the estate. According to Florida Law, the following persons have priority to serve as the administrator: 1. The surviving spouse of the deceased 2. A descendant of the deceased 3. A relative of the deceased 4. A creditor of the deceased 5. A designated personal representative 6. A public administrator If none of these persons are willing or able to serve, then the Court may appoint any qualified person to serve as the administrator. Generally, the person must be a legal resident of Florida and 18 years or older. In some cases, an individual can be disqualified from serving as an administrator. A person who receives a court order suspending or revoking their right to serve as an administrator, or someone who has been convicted of a felony involving dishonesty or breach of trust cannot serve as an administrator. Additionally, any person who has been found to be legally incapacitated, or who is a minor, may not be appointed as an administrator.
