What are the rights of juveniles in the criminal justice system?
In California, juveniles have certain rights that are protected by the state’s juvenile criminal justice system. These rights include the right to remain silent, the right to an attorney, the right to a fair and impartial trial by jury, the right to know and understand the charges against them, and the right to be protected against self-incrimination. Additionally, they have the right to be treated with respect and dignity throughout the judicial process and to be heard by the court prior to any sentencing or release. In addition to these rights, juveniles have the right to have their cases heard in a separate Juvenile Court system that is separate from the adult criminal justice system. This ensures that juveniles have an opportunity to have their cases heard in a setting that focuses on rehabilitation and provides resources to help them turn their lives around. Additionally, juveniles are subject to different sentencing guidelines than adults and may also receive special considerations relating to their age, such as shorter sentences or alternative programs. Finally, juveniles in the criminal justice system have the right to appeal their case if they believe the decision of the court was unjust or unfair. This appeals process allows for the juvenile court system to reach a more equitable solution to their case and help ensure that juveniles are treated fairly in the justice system.
