What methods are used to determine guilt in a juvenile delinquency case?
In North Carolina, determining guilt in a juvenile delinquency case is a little different than an adult criminal case. Rather than a jury trial, a judicial officer, such as a judge or magistrate, will be responsible for making the determination of guilt. This officer will consider the evidence provided by the prosecutor, defense attorney, the juvenile, as well as from any witnesses. The judicial officer will consider the laws that were broken and the evidence of whether the juvenile committed the act. Generally, there is a burden of proof, which is set by a “preponderance of evidence” standard. This means that the judge must be persuaded that it is more likely than not that the juvenile committed the act. The judge can then decide if the juvenile is guilty or not guilty. The judge will also take into consideration the juvenile’s age, any history of delinquency, family circumstances, and whether he or she has been previously adjudicated. The judge may also refer the juvenile to counseling or rehabilitation services to help them address any underlying issues before a ruling is made. If the judge determines that the juvenile is guilty of a delinquent act, then the judge may impose a sentence that includes probation, community service, detention, or other rehabilitative measures if they are deemed suitable for the juvenile. The judge may also consider other sources of information from outside the criminal justice system, including mental health professionals, teachers, and social workers, to ensure that the sentencing is appropriate and that the juvenile receives the necessary help.
