What is the history of constitutional law in jurisprudence?
Washington State has a rich history in regards to constitutional law in jurisprudence. In the late 1800s and early 1900s, the Washington Supreme Court laid the groundwork for modern constitutional jurisprudence in the state. In 1887, the court issued its first written decision on constitutional law, In re Smith. In this case, the court found that the state’s constitutional prohibition of fraudulent voting should be interpreted more broadly to also prohibit intimidating voter behavior. This decision laid the foundation for the court’s interpretation of the state constitution in later cases. In the 20th century, Washington courts further developed their jurisprudence by expanding their interpretations of the state constitution and by bringing more weight to important constitutional cases. This resulted in landmark decisions such as the court’s 1907 ruling in State v. Kane, which held that the state constitution’s protections against unreasonable search and seizure should extend to non-governmental actors. In the years since then, the court has continued to refine its approach to constitutional law. For example, in 2013, it revisited the issue of voter intimidation in State v. Deloge and found that, although the state constitution did not specifically prohibit it, the practice could be taken into account in evaluating the fairness of an election. These decisions have had a large impact on the development of constitutional law in Washington State. As the court continues to interpret the state constitution, its decisions will continue to shape how people live and interact with the state and its laws.
