What is the process of transferring a juvenile case to adult court?

In Texas, the process of transferring a juvenile case to adult court involves a few steps. First, a judge or a prosecutor must make a motion in the juvenile court for the transfer of the case. This motion must include evidence that the accused is a danger to the public or is not likely to be rehabilitated or is engaged in organized criminal activity. The judge must also consider various factors, including the degree of the offense, the previous criminal record of the accused, and the age, maturity, and background of the accused. If the motion is granted, the case is then heard in an adult court. The juvenile court judge will decide if the accused is competent and well-informed enough to stand trial in adult court. During this time, the juvenile court will have the authority to order psychological and other evaluations as well as collect evidence. Once the judge has determined the juvenile is competent and prepared, the case is then tried in an adult court. During this trial, the juvenile is subject to the same procedures and laws as an adult would be. After the case is decided, the juvenile court can order a variety of outcomes, including probation, community service, and incarceration in a juvenile detention center. If the sentence is incarceration, the juvenile court judge may also transfer the case to an adult prison if they believe the accused is unable to benefit from the juvenile system due to age or severity of crime.
