What is the process for appealing a juvenile court decision?

In California, the appeals process for a juvenile court decision starts after the parties involved receive notice of the decision. The party who wishes to appeal the decision must, within 30 days of receiving the notice, file a notice of appeal with the juvenile court that issued the decision, which includes the specific reasons for the appeal. Appeals must be based on errors or misinterpretations of law, or mistakes or other irregularities that affected the original outcome of the decision. After the notice of appeal is filed, the court will set a hearing date. During the hearing, both the appellant and the respondent (the person who was originally the subject of the court decision) will have an opportunity to present new evidence and legal arguments that they believe support the appeal. Either party may also be represented by a lawyer. The court may also review the record of the original trial, conduct additional research and review reports of witnesses, but it will not hear testimony from witnesses. After the hearing, the court will issue a written decision, which will either uphold the original decision, or reverse it in whole or in part. If the appellant disagrees with the ruling, they may appeal the decision to the California Court of Appeal. The Court of Appeal may also hear the case “de novo,” meaning that it can consider the issue as if it were hearing it for the first time. Regardless of the outcome, the decision made by the appellate court is final—except for in rare instances in which the California Supreme Court hears a second appeal. In all cases, appeals in the juvenile court must be timely, and all appeals must go through the juvenile court before they can be taken to the higher circuits.
